Arizona Court of Appeals enforced a prenup despite the challenging spouse claiming she lacked knowledge of the other's business assets — holding that Arizona's UPAA allows parties to waive full disclosure if they have adequate knowledge of the other's finances.
Why this case matters
Pownall is the controlling Arizona authority on what counts as "adequate knowledge" of a spouse's finances. The case sets a relatively forgiving bar for Arizona prenup proponents, but the corollary lesson matters too: spouses who voluntarily stayed ignorant of the other's finances during the engagement cannot resurrect that ignorance to defeat the prenup years later.
The facts
The Pownalls signed a prenuptial agreement before their Arizona marriage. The husband owned business interests. At divorce, the wife sought to invalidate the prenup, arguing she had not been informed of the full extent of the husband's business assets. The trial court agreed and invalidated the agreement. The husband appealed.
The holding
The Court of Appeals reversed. Under Arizona's UPAA, the challenging spouse must prove either involuntary execution or (a) unconscionability at signing AND (b) lack of fair and reasonable disclosure AND (c) no waiver of disclosure AND (d) no adequate independent knowledge. The court found the wife had sufficient knowledge of the husband's finances to satisfy the "adequate knowledge" prong — even without a formal disclosure schedule.
What it means for you
- Arizona's UPAA disclosure requirement can be satisfied by adequate independent knowledge — not just formal disclosure.
- A spouse who knew or could have known about the other's finances cannot later claim ignorance.
- Formal sworn disclosure schedules are still the best practice, but their absence is not automatically fatal.
