Which state do you live in?

Your state's law governs postnup enforceability. We'll factor it into the recommendation.

How postnups differ from prenups

A postnup is signed during the marriage; a prenup is signed before. The two cover similar substantive ground — separate property, support, what happens at divorce — but courts apply stricter scrutiny to postnups because married spouses owe each other a fiduciary duty. For the full comparison, see prenup vs. postnup.

A postnup is most useful when something has changed: a spouse started a business, an inheritance is incoming, the couple wants to clarify finances after a dispute, or the couple skipped a prenup before the wedding and wants protection now.
